Welcome to Diamond Tuning & Performance (DTP). By visiting diamondtp.com, booking services, purchasing merchandise, or enrolling in training, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the website or services.
Introduction
What these terms are
These Terms of Service (Terms) explain the rules for using our website and doing business with DTP. They apply to website visitors, customers, and anyone purchasing services, merch, or courses from us.
Updates to these terms
We may update these Terms from time to time. When we do, we will post the updated version on this page. If you keep using the website or services after changes are posted, that means you accept the updated Terms.
Services and What We Offer
General services
DTP provides professional automotive services that may include:
Performance tuning through HP Tuners
ECU and TCU flashing
Diagnostics and troubleshooting
Dyno tuning or dyno testing when available
Custom vehicle solutions and consultation
Merchandise sales
Tuning courses and training
Service requirements
Some services require specific information before we can begin. That can include your vehicle year, make, model, engine, transmission, current modifications, fuel type, and goals.
If we do not have accurate information, we may not be able to complete the service as scheduled.
Eligibility and Customer Responsibilities
Age requirement
You must be at least 18 years old to book services or make purchases on diamondtp.com unless you have permission from a legal guardian.
Accurate information
You agree to provide accurate, complete information when:
Requesting quotes
Booking appointments
Purchasing services
Ordering merch
Enrolling in training
Giving incomplete or incorrect information can lead to delays, extra charges, rescheduling, or a refusal of service.
Vehicle access and authorization
If you bring or send a vehicle to us, you confirm you have the legal right to authorize work on that vehicle.
Appointments, Scheduling, and Shop Policies
Appointments and reserved time
Appointments reserve shop time that cannot always be replaced on short notice. Please be on time and prepared.
Late arrivals and missed appointments
If you arrive late, we may have to shorten your appointment, reschedule it, or cancel it depending on the day’s schedule.
If you miss your appointment or no show, you may be charged a fee as listed on the specific service page.
Cancellations and rescheduling
Cancellation and rescheduling fees are listed on each service page on diamondtp.com and apply as written. It is your responsibility to review the service page before booking.
Refusal of service
We reserve the right to refuse or stop service if a vehicle is unsafe, poorly maintained, improperly modified, leaking, overheating, or otherwise not in a condition we believe is safe to work on or tune.
Payments, Pricing, and Taxes
Payment timing
Payment is due at the time of purchase or service unless we specifically agree otherwise in writing.
Pricing changes
Prices can change at any time. The price you pay is the price shown or agreed to at the time you place the order or book the service.
Taxes and fees
Where required, taxes and applicable fees may be added at checkout.
Chargebacks and payment disputes
If something seems wrong with a charge, contact us first. We will work with you to resolve it when possible.
If a chargeback is filed for services already performed or goods already delivered, we may provide documentation to the payment processor including appointment records, messages, order details, logs, or proof of delivery.
Refunds, Returns, and Cancellations
Services and custom work
Tuning, flashing, diagnostics, dyno time, consultation, and other vehicle-specific services are custom. Once work has started or a service has been performed, it is non-refundable.
Service concerns and follow-up
If you believe something is not operating as expected after a service, contact us as soon as possible. We may request logs or additional information to review your concern.
Support is meant to address issues related to the original service, not unlimited revisions for hardware changes, unrelated mechanical issues, or unsafe requests.
Merchandise returns and exchanges
Merchandise return and exchange eligibility depends on the product type and condition.
In general:
Items must be unused and unworn to qualify
Return windows and requirements apply as listed in our posted policies
Some items may be non-returnable due to hygiene, safety, or product type
Merch is fulfilled by Printful unless otherwise noted, and fulfillment rules may affect what can be returned or replaced.
Digital products
Digital products and downloadable items are non-refundable once delivered or accessed, because they cannot be returned.
Training and courses
Tuning courses are eligible for a full refund with a 100 dollar cancellation fee as long as you cancel at least 3 full weeks before the training start date.
Cancellations inside that window may be non-refundable due to scheduling, staffing, and materials.
Vehicle Condition, Risk, and Customer Responsibility
You are responsible for vehicle condition
You are responsible for making sure your vehicle is in safe mechanical condition before tuning, diagnostics, or performance work.
This includes basic things like:
No major fluid leaks
Healthy ignition and fuel system
Proper cooling system function
Good battery and charging voltage
Safe tires and drivetrain condition
Disclose modifications and important history
You must disclose all relevant modifications and known problems before service. Hidden or undisclosed changes can affect results and safety.
Customer supplied parts
If you provide parts, you are responsible for ensuring they are correct and functional. We are not responsible for failures caused by defective customer-supplied parts.
Pre-existing issues and hidden defects
Performance work can expose weak points. DTP is not responsible for damage caused by pre-existing mechanical issues, improper modifications, poor maintenance, or hidden defects that fail during or after service.
Performance and Results Disclaimer
No guaranteed results
Every vehicle is different. Power gains and results vary based on:
Vehicle condition
Supporting modifications
Fuel quality
Weather and altitude
Sensor health and calibration limits
Traction and drivetrain condition
We do not guarantee a specific horsepower number, torque number, quarter mile time, fuel economy improvement, or reliability outcome.
Racing and aggressive use
If you use your vehicle for racing, towing, off-road, or aggressive driving, you accept increased risk and wear. Tuned vehicles require responsible ownership and maintenance.
Compliance and Legal Notes
Emissions and street legality
You are responsible for complying with local, state, and federal laws regarding emissions equipment and modifications. We do not guarantee that a modified vehicle is street legal everywhere.
Safety decisions
We may refuse requests we believe are unsafe for the vehicle, driver, or public.
Website Rules and Acceptable Use
Intellectual property
All content on diamondtp.com including logos, photos, branding, designs, and written content belongs to DTP or is used with permission. You may not copy, reproduce, distribute, or reuse our content without written permission.
Prohibited uses
You agree not to:
Use the website for illegal purposes
Attempt to break, disrupt, or overload the site
Try to access accounts, checkout, or systems you are not authorized to access
Upload malicious code, scripts, or harmful files
Misrepresent your identity or vehicle information
Use the site to harass, threaten, or abuse others
Privacy
Privacy policy applies
Your use of diamondtp.com is also governed by our Privacy Policy. By using the site, you agree to our collection and use of information as described there.
Limitation of Liability
No liability for certain losses
To the maximum extent allowed by law, DTP is not responsible for:
Mechanical failures that occur during or after tuning or performance work
Damage caused by pre-existing problems, poor maintenance, or improper modifications
Damage caused by customer-supplied parts
Loss of use, lost time, lost income, or towing costs
Website downtime, checkout errors, or temporary service interruptions
You accept the risks of performance modification
Performance modifications can increase stress on engine, transmission, drivetrain, and supporting components. You understand and accept those risks when you choose performance services.
Termination and Refusal of Service
Our right to refuse service
We may refuse, suspend, or terminate service if a customer:
Violates these Terms
Behaves in a threatening, abusive, or unsafe way
Attempts fraud, chargeback abuse, or deception
Requests unsafe work or refuses to follow shop safety rules
Disputes and Governing Law
Wisconsin law
These Terms are governed by the laws of the State of Wisconsin.
Dispute resolution and arbitration
If a dispute comes up, contact us first so we can try to resolve it directly.
If we cannot resolve it, both parties agree to resolve disputes through binding arbitration under the rules of the American Arbitration Association, unless prohibited by law or unless a claim qualifies for small claims court.
Venue
If a dispute must be handled in court for any reason, it will be handled in Wisconsin unless otherwise required by law.
